1. Acceptance of Terms

By accessing or using GigaChadCharts ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Your continued use of the Service following any updates to these terms constitutes acceptance of those changes.

2. Description of Service

GigaChadCharts is a web-based backtesting platform for NQ (Nasdaq 100 E-mini) futures. The Service allows users to test trading strategies against historical market data.

The Service is offered with a free tier and optional paid subscription tiers that unlock additional features and capabilities.

3. User Accounts

To access certain features, you must create an account using Google Sign-In. By creating an account, you agree to:

• Maintain only one account per person
• Provide accurate and current information
• Keep your account credentials secure
• Accept responsibility for all activity under your account

4. Free Tier

The free tier provides full access to the core backtesting engine, including unlimited trades and strategy creation. There are no time limits or artificial restrictions on the free tier.

5. Paid Tiers

GigaChadCharts offers two paid subscription tiers:

• MegaChad — $100/month
• GigaChad — $250/month

All subscriptions are billed monthly via Stripe. You may cancel your subscription at any time and will retain access through the end of your current billing period. No refunds are issued for partial billing periods.

6. User Content

You retain full ownership of all strategies, trade data, and configurations you create on the Service. We do not claim any intellectual property rights over your content.

7. Acceptable Use

You agree not to:

• Abuse, disrupt, or overload the Service or its infrastructure
• Scrape, crawl, or extract data from the Service via automated means
• Launch automated attacks, including denial-of-service attacks
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service for any illegal purpose
• Resell or redistribute access to the Service without authorization

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee the accuracy of historical data, backtest results, or any analysis provided by the Service. You are solely responsible for your trading decisions. We are not responsible for any trading losses you may incur.

9. Limitation of Liability

To the maximum extent permitted by applicable law, GigaChadCharts and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination.

11. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you via email or a prominent notice within the Service at least 14 days before the changes take effect.
